SMS / Text Messaging Terms & Conditions

These SMS / Text Messaging Terms & Conditions (“SMS Terms”) govern your participation in the text messaging program (the “Program”) offered by BLVD Management & Advisory LLC (“BLVD,” “we,” “us,” or “our”). By opting in to receive text messages from BLVD, you agree to these SMS Terms and to our Privacy Policy, which is incorporated by reference and describes how we collect, use, and protect your information, including your mobile information.
1. Program Description
The Program is used to send text messages related to rental inquiries and applications, showings and appointment reminders, maintenance and service updates, and lease or account notifications regarding BLVD-managed properties. If you separately opt in, we may also send promotional messages about available units. Message content will vary based on your relationship with BLVD (e.g., prospect, applicant, or resident).
2. Opt-In
You may opt in to the Program by providing your mobile phone number and affirmatively consenting through one of the following methods: checking an opt-in box on our website or an application form, replying to a text message invitation, or providing verbal consent that is confirmed by a follow-up text message you can accept or decline. Consent to receive text messages is not required to rent from BLVD or to use our services, and is not a condition of any purchase.
3. Message Frequency
Message frequency varies depending on your interactions with BLVD and the properties you are interested in or reside at (for example, more messages during an active application or maintenance request, and fewer at other times).
4. Cost
Message and data rates may apply, depending on your mobile carrier and plan. BLVD does not charge a separate fee for text messages, but your carrier’s standard messaging rates apply.
5. Opt-Out
You may opt out of the Program at any time by replying STOP to any text message you receive from us. After you reply STOP, we will send a one-time confirmation message and you will not receive further text messages from BLVD unless you opt in again. You may also request to be removed by contacting us using Section 9 below. Opting out of text messages will not affect your lease, application, or any other service you receive from BLVD.
6. Help
For help at any time, reply HELP to any text message you receive from us, or contact us using Section 9 below.
7. Supported Carriers
The Program is available on most major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages.
8. Privacy
We do not share your mobile phone number or your text-messaging opt-in status or consent with third parties or affiliates for their own marketing or promotional purposes. Text-messaging originator opt-in data and consent are not shared with any third party for any purpose, except with our SMS/texting platform and telecommunications service providers solely to transmit the messages you request, as necessary to fulfill a specific request you made, or as required by law. 10. Changes to These Terms
We may update these SMS Terms from time to time. The “Effective Date” above reflects the date of the current version. Material changes will be posted on this page, and your continued participation in the Program after changes take effect constitutes acceptance of the revised SMS Terms.
11. Eligibility and Governing Law
The Program is available only to individuals who are at least 18 years old and who are the account holder or have the account holder’s permission for the mobile number provided. These SMS Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws principles.
