Privacy Policy

BLVD Management & Advisory LLC (doing business as “BLVD Management,” and referred to herein as “BLVD,” “we,” “us,” or “our”) provides property management services in Minnesota. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit blvd-management.com (the “Site”), submit an online application or inquiry, use our Resident or Owner Portal, submit a maintenance request, or otherwise interact with us. This Policy is incorporated by reference into, and should be read together with, any lease, application, or other agreement between you and BLVD.

By using the Site or our services, you agree to the collection, use, and disclosure of your information as described in this Policy. If you do not agree, please do not use the Site or provide us with personal information.

1. Information We Collect

When you submit our online application or inquiry form for a specific apartment, we collect only:

We use this information to respond to your inquiry, evaluate your interest in a specific unit, and, if you proceed, to move you into our full leasing and screening process.

1.2 Full Rental Application and Tenant Screening

If you move forward with renting from BLVD, our leasing process (conducted through our third-party leasing and screening platform, Rent Manager, and its screening partners) separately collects additional information necessary to evaluate your application, including your date of birth, Social Security Number or Individual Taxpayer Identification Number, income and employment information, and rental history, and to obtain a consumer/background report covering credit history, criminal history, and eviction history, in each case as permitted by Minnesota law and the federal Fair Credit Reporting Act (“FCRA”). This information is collected and processed by Rent Manager and its screening partners subject to their own privacy policies, in addition to this Policy.

1.3 Resident, Owner, and Maintenance Information

When you visit the Site, we and our service providers may automatically collect limited technical information through cookies, log files, and similar technologies, including IP address, browser and device type, pages viewed, and referring/exit pages. We do not use this information to serve you third-party advertising. See Section 6 below.

BLVD does not display third-party advertising on the Site, and we do not use, share, or sell personal information for cross-context behavioral or targeted advertising. We do not sell personal information, as that term is defined under applicable state privacy laws. We do not charge a fee to submit an online application or inquiry, and we do not collect payment card information through the application or inquiry form. If you later make rent or other payments through the Resident Portal, that payment information is collected and processed directly by Rent Manager under its own privacy and security terms, and BLVD does not directly store your full payment card or bank account numbers.

3. Text Messaging (SMS) Communications

If you provide your mobile phone number and opt in, BLVD may send you text messages related to your rental inquiry or application, showings and appointment reminders, maintenance and service updates, and lease or account notifications. If you separately opt in, we may also send promotional messages about available units.

Consent to receive text messages is not a condition of any rental, application, purchase, or service. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any text message, or reply HELP for help. You may also contact us using Section 13 below. Carriers are not liable for delayed or undelivered messages.

Mobile Information and Opt-In Data. We do not share your mobile phone number or your text-messaging opt-in status or consent with third parties or affiliates for their own marketing or promotional purposes. Text-messaging originator opt-in data and consent are excluded from all categories of information sharing described elsewhere in this Policy and will not be shared with any third party for any purpose, except: (a) with our SMS/texting platform and telecommunications service providers solely to transmit the messages you request or agree to receive, (b) as necessary to fulfill a specific request you made (for example, confirming a maintenance appointment), or (c) as required by law.

6. Cookies and Tracking Technologies

The Site may use cookies and similar technologies to operate the Site, remember basic preferences, and understand aggregate usage patterns (e.g., analytics). These technologies are not used to serve targeted advertising. You can block or delete cookies through your browser settings; doing so may affect some Site functionality. The Site does not currently respond to browser “Do Not Track” signals, because no uniform industry standard for such signals has been adopted.

7. Data Retention

We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this Policy, including to satisfy legal, tax, accounting, fair-housing, and lease-related recordkeeping obligations, after which it is securely deleted or de-identified in accordance with our internal retention practices.

8. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or destruction, and we limit access to personal information to personnel and service providers with a legitimate business need. No method of electronic transmission or storage is completely secure, and while we work to protect your information, we cannot guarantee absolute security, and you provide information to us at your own risk. To the fullest extent permitted by law, BLVD disclaims liability for unauthorized access to or use of your personal information that occurs despite our reasonable safeguards, including breaches caused by third-party service providers, criminal acts of third parties, or circumstances beyond our reasonable control.

9. Your Privacy Rights

9.1 Minnesota Residents — Minnesota Consumer Data Privacy Act

Minnesota residents may have rights under the Minnesota Consumer Data Privacy Act (Minn. Stat. § 325M) to: confirm and access personal data we hold about you; correct inaccuracies; delete personal data; obtain a portable copy of your data; opt out of targeted advertising, sale of personal data, or certain profiling (note: as described in Section 2, BLVD does not currently engage in targeted advertising or sale of personal data); and appeal a denial of your request, including ultimately to the Minnesota Attorney General.

9.2 Other State Privacy Laws

If you reside in another state with a comprehensive consumer privacy law, you may have similar rights. Contact us using Section 13 below and we will evaluate your request under applicable law.

9.3 Consumer Reports and the FCRA

If, during the full rental application process, we obtain a consumer or background report about you, you have rights under the FCRA, including the right to know if information in your file was used against you, to know what is in your file, to dispute inaccurate or incomplete information directly with the consumer reporting agency, and to obtain a free copy of your file under certain circumstances. We will provide any legally required adverse action notice if we deny your application, in whole or in part, based on a consumer report.

To submit any privacy rights request, email info@blvd-management.com with the subject line “Privacy Rights Request.” We will verify your identity before responding and will respond within the time required by applicable law. We will not discriminate against you for exercising these rights.

10. Children’s Privacy

The Site and our services are directed to adults and are not intended for children under 13. We do not knowingly collect personal information from children under 13. If we learn we have inadvertently done so, we will promptly delete it.

11. Third-Party Links and Platforms

The Site links to third-party platforms we do not own or control, including our Resident Portal, Owner Portal, and leasing/application system (hosted by Rent Manager) and our maintenance request platform (hosted by Property Meld). Those platforms are governed by their own privacy policies. BLVD is not responsible for the privacy or security practices of any third-party platform, and your use of those platforms is at your own discretion.

12. Limitation of Liability; Governing Law

To the maximum extent permitted by applicable law, BLVD, its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to this Privacy Policy, the Site, or the processing of your personal information, even if advised of the possibility of such damages. Nothing in this section limits any rights that cannot be waived under applicable Minnesota or federal law.

This Policy is governed by the laws of the State of Minnesota, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to this Policy shall be subject to the exclusive jurisdiction of the state or federal courts located in Hennepin County, Minnesota, unless your lease or another signed agreement with BLVD specifies a different dispute-resolution process (such as arbitration), in which case that agreement will govern disputes covered by it.

13. Changes to This Policy; Contact Us

We may update this Privacy Policy from time to time to reflect changes in our practices, vendors, or applicable law. The “Effective Date” above reflects the date of the current version, and material changes will be posted on this page. Your continued use of the Site or our services after changes take effect constitutes your acceptance of the revised Policy. If any provision of this Policy is found unenforceable, the remaining provisions will remain in full force and effect.
